DATA PROTECTION POLICY

1. General information on processing of personal data:

The controller processing personal data through the site www.riongo.com is KRAGMAN GMBH, a legal entity incorporated in accordance with applicable law, with headquarters at Schillerstraße. 3, 76676 Graben-Neudorf, Germany.

The operator – KRAGMAN GMBH (hereinafter referred to as the “Operator” or “RIONGO”) can be contacted at the aforementioned office or by e-mail info@riongo.com.

2. Personal data processed by the operator through www.riongo.com:

The operator receives personal data based on voluntary provision thereof by the data subjects (Clients / Users of the site, as defined in clause 1 of these Terms and Conditions („Definitions”). The type of received personal data depends on the nature of visitor interaction with the website www.riongo.com.

Personal data is processed by RIONGO:

2.1 RIONGO may collect contact details, including such personal data as name, surname, e-mail, phone number, etc.  Besides, it may process recipient’s name and surname, as well as phone number.

2.2. When registering an account, the user indicates his/her name, surname, e-mail address, and phone number. To use the Account, the password and contact details in appropriate sections of the Account are processed.

2.3. In order to contact KRAGMAN GMBH for any questions or for information about its products, you shall provide your name, surname, and e-mail address;

2.4. For marketing purposes, the e-mail address is processed for sending of newsletters.

3. OTHER CATEGORIES OF COLLECTABLE DATA

3.1.  KRAGMAN GMBH may involuntarily receive other data that does not unambiguously identify the data subject (time of visit, place of access, name and version of the Internet browser, operating system, including other technical parameters) provided by the Internet browser that may be available on the website and may be used by KRAGMAN GMBH to improve the processing and execution services offered to its Clients or Users.

3.2. KRAGMAN GMBH may also involuntarily collect any information that will identify visitors to the www.riongo.com website, such as IP address, city and country where the Customer / User is located. KRAGMAN GMBH will not use such information to identify site visitors, and will not publish such information for any purpose not specified in this Privacy Policy.

3.3. Website www.riongo.com is linked to the social networks Facebook and Instagram in an internet marketing network based on the behavior of website visitors. Consequently, there will be lines of code on the Facebook and Instagram page stating that the person has visited a page owned by KRAGMAN GMBH and therefore has an interest in products similar to those sold by KRAGMAN GMBH. In addition, Facebook and Instagram, as part of broader marketing networks, can generate other information on the stakeholder’s workstation about their partners in the same field. By blocking the cookies download you will also block these messages from Facebook, Instagram or partner networks.

4. DATA PROCESSING PURPOSES AND GROUNDS 

4.1. KRAGMAN GMBH processes personal data for the following purposes and on the following legal grounds:

• based on consent of the User / Client of the site to contact him/her and to provide information about the products sold at his/her voluntary request;
• based on explicit consent of the User / Client of the site for marketing purposes to send newsletters exclusively in electronic form;

• in the legitimate interests of the Operator, the personal data specified in Art. 2 and Art. 3 to improve the services offered to Users or Clients, including, but not limited to, periodically contacting them for sending of personal messages based on the relevant relationships between KRAGMAN GMBH and the Client / User in accordance with the  applicable data protection laws;

4.2. By visiting the website, creating an account, filling out contact forms or requesting information about any product, each data subject gives KRAGMAN GMBH consent to the processing of his/her personal data for the purposes specified in this Privacy Policy.

4.3. KRAGMAN GMBH processes personal data in a lawful, fair and transparent manner. Personal data is processed for specific, explicit, and legitimate purposes. Data processing shall be adequate and limited only in pursuance of achievement the goal for which they were obtained. Personal data will only be stored for the time necessary to achieve the goals for which they are processed, and the processing will be carried out in an appropriate manner to ensure the security and integrity of the data. Data transfer shall be carried out with proper precautions.

4.4. KRAGMAN GMBH applies the necessary organizational and security measures to protect personal data from any unauthorized access, use, alteration or destruction in accordance with applicable international and national laws. 

4.5. KRAGMAN GMBH shall not disclose any personal data obtained through website www.riongo.com to any persons other than its authorized employees and contractors / partners who are duly authorized  and who need the above data for processing on behalf of KRAGMAN GMBH, or if the obligation to disclose the above data is a legally binding obligation of KRAGMAN GMBH or its employees or contractors / partners. KRAGMAN GMBH and its officers (authorized persons) shall be liable for implementation of relevant technical and organizational measures to ensure confidentiality and safety of personal data.

5. DATA SUBJECT RIGHTS

5.1. Any User or Client as a data subject has the following rights in relation to KRAGMAN GMBH as a controller of personal data:

5.1.1 The access right means the User’s or Client’s right to receive confirmation from KRAGMAN GMBH for processing or non-processing of  data of the person concerned, and, in the case of processing, confirmation of access to the above data and information, including also information on the data processing procedure.

5.1.2. Data transmission right refers to the right to receive personal data in a structured, commonly used, and machine readable form, as well as the right to transfer this data directly to another controller, but only if this is technically possible.

5.1.3. The right to object refers to the User’s or Client’s right to object the processing of his/her personal data when it is necessary for fulfillment of a task serving the public interest, or when it concerns the legitimate interest of the controller. When processing of personal data is aimed at direct marketing, a User or the Client has a special right to refuse such processing at any time.

5.1.4. The right to rectification refers to rectification of inaccurate personal data without any unreasonable delay. Correction will be communicated to each addressee to whom the data has been transmitted, unless it proves impossible or requires a disproportionate effort on the part of KRAGMAN GMBH.

5.1.5. The right to erase the data (“right to be forgotten”) means the User’s or Client’s right to request the erasure of personal data without any unreasonable delay, for one of the following reasons: it is no longer needed to fulfill the purpose for which it was collected or processed; the person concerned decides to withdraw hie/her consent and there is no other legal basis for the processing; the person concerned objects to the processing and there is no legitimate reason for the title; personal data has been processed unlawfully; personal data must be deleted in accordance with the law; personal data was collected in connection with the provision of any information society services.

5.1.6. The right to restrict the processing can be exercised if a User or a Client disputes the accuracy of the data processed by KRAGMAN GMBH for a period allowing verification of the data accuracy; the processing is unlawful and the person concerned objects to the deletion of the personal data, instead requesting the restriction thereof; if KRAGMAN GMBH no longer needs personal data for processing purposes, but the person concerned requests to establish, exercise or defend his/her rights in court; if the person objects the processing within a certain period of time during which a check of whether the legal rights of KRAGMAN GMBH prevail over the rights of a User or a Client is carried out.

6. PROCESSING DURATION

6.1. Personal data processed by KRAGMAN GMBH is stored for a period of 3 to 10 years, depending on the purpose of collection thereof, namely: data provided under the order form will be stored for 10 years from the data collection date, data collected for account creation purposes will be stored for 3 years from the moment of the last communication with the User, data provided at filling out the contact form or requesting information about the product will be stored 3 years from the data collection date for marketing purposes based on the explicit consent of the data subject prior to withdrawal of such consent, and data processed for marketing purposes in the legitimate interests of the Operator will be stored for 5 years starting from the last visit of www.riongo.com.

7. TRANSMISSION OF PERSONAL DATA

7.1. If necessary, we may transfer or provide access to certain personal data to the following categories of recipients:

• Providers of marketing services;
• Providers of IT services.

8. STORAGE OF PERSONAL DATA

8.1. Personal data is processed in the European Union. It must be kept for a period consistent with the purpose for which it was collected. As a rule, the processed personal data is deleted by deleting from the electronic records immediately following the provision of the service requiring such collection.

9. AMENDMENT OF THE PRIVACY POLICY

9.1. If KRAGMAN GMBH believes that there is a need to make any changes to the Privacy Policy, the company will publish the above changes to inform the appropriate data subjects about the information collected and how it is used.
